Training pill: The Conciliation Ballot

Juan José Banciella, professor in the Master in HR Management at the EIP International Business School, Official of the Administration of Justice, comes to talk to us about a fundamental procedure within the Social Jurisdiction: attempt at mandatory Conciliation prior to the jurisdictional route.

In this training pill, which you can find on the Channel Youtube from the EIP International Business School, tells us about the Conciliation Ballot.

It is a procedure prior to the jurisdictional route that is filed before an administrative body that depends on the general directorates of work of the CCAA and is known as SMAC.

The importance within the conflict with the worker who has the conciliation document is greater since once it has been presented, and an agreement has not been reached, we are influenced by the issues it contains. By this we mean that, in the lawsuit, we could not separate ourselves from what the ballot contains, in terms of the claims.

Add that, upon presenting the conciliation ballot, the expiration and prescription periods are suspended.

It should be noted that the agreements reached in this conciliation act have executive force between the parties. Which means that you can request that what was agreed be executed.

The conciliation ballot is one of the skills that an HR professional has to keep in mind in order to manage possible conflicts between workers and Public Administrations, knowledge that is taught in the Master in HR Management at the EIP International Business School.
