Code of Good Professional Tax Practices

The Code of Good Professional Tax Practices includes a series of principles, commitments and recommendations that have been prepared and approved by the Forum of Associations and Colleges of Tax Professionals to help improve the cooperative relationship between the Tax Agency and fiscal intermediaries, as well as to promote good tax practices by taxpayers.

The participating schools and associations must have a code of ethics for the tax advisory activity, committing to maintain an information channel with the Tax Agency in case of irregularities or bad practices of its associates, respecting the limits of professional secrecy in any case.

What principles have been developed and approved?

The principles included in the Code of Good Practices for Tax Professionals are:

  • Willfulness, adherence to the code is voluntary.
  • Bilaterality, includes commitments for both fiscal intermediaries and the tax administration.
  • Transparency and trust, delivery of information beyond legal requirements.
  • Mutual agreement.
  • Collaboration.
  • Confidentiality and privacy in the information provided.
  • Ease of communication, through an online channel that allows the relationship between intermediaries, associations and professional associations and the Tax Agency to be more agile.

Corresponding commitments for both parties

As for the commitments, these are established both for the fiscal intermediaries as for the Tax agency.

Between the commitments for fiscal intermediaries They include: ensuring that the actions of their clients comply with current tax legislation, informing the association or school of detected irregularities or correcting possible client behavior that may cause a tax risk, among others.

On the other hand, the Tax Agency is committed to establish a communication channel on the web, to improve the application of the tax system, to organize dissemination and communication campaigns aimed at professional associations and associations adhering to the Code of Good Practices or to identify tax returns submitted by tax intermediaries.

This Code is a key element in Tax Compliance to control the tax risks of possible breaches of tax regulations.
