{"id":48809,"date":"2021-11-18T09:57:34","date_gmt":"2021-11-18T08:57:34","guid":{"rendered":"https:\/\/eiposgrados.com\/?p=48809"},"modified":"2021-11-18T09:57:34","modified_gmt":"2021-11-18T08:57:34","slug":"how-are-the-ertes","status":"publish","type":"post","link":"https:\/\/eiposgrados.com\/eng\/blog-rrhh\/como-quedan-los-ertes\/","title":{"rendered":"How do ERTES look after September 30, 2021?"},"content":{"rendered":"<p>With the approval of the <strong>Royal Decree-Law 18\/2021 of September 28<\/strong>, of urgent measures for the protection of employment, economic recovery and improvement of the labor market, which, among other measures, includes <strong>the new extension of the ERTES from October 1, 2021 until February 28, 2022.<\/strong><\/p>\n\n\n\n<h2 class=\"gb-headline gb-headline-09b9d5f7 gb-headline-text\"><strong>What type of ERTES are extended?<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\"><li>ERTE due to Force Majeure regulated by RD-Law 8\/2020.<\/li><li>ERTE due to impediment of activity regulated by RD-Law 24\/2020, by RD-Law 30\/2020 and by RD-law 2\/2021.<\/li><li>ERTE due to impediment or limitations of activity regulated by RD-Law 11\/2021.<\/li><\/ul>\n\n\n\n<h3 class=\"gb-headline gb-headline-22f53daa gb-headline-text\"><strong>Are the Ertes automatically extended?<\/strong><\/h3>\n\n\n\n<p><strong>No, you must submit an application to the Labor Authority between October 1 and 15. <\/strong>This request must be accompanied by a list of the hours and days suspended between the months of July and September for each of the workers. <strong>The Labor Authority has a period of 10 business days to issue a resolution<\/strong> If, after this period, no ruling is made on the matter, the extension will be deemed to have been approved.<\/p>\n\n\n\n<p><strong>If the application is not submitted <\/strong>within the established period <strong>the ERTE will be terminated<\/strong> and will not be applicable from November 1, 2021<\/p>\n\n\n\n<h3 class=\"gb-headline gb-headline-d2367ed8 gb-headline-text\"><strong>What requirements do companies that apply for ERTES have to meet?<\/strong><\/h3>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>It&#039;s prohibited <\/strong>the realization of <strong>overtime and outsourcing.<\/strong><\/li><li><strong>The employment safeguard is maintained.<\/strong> Companies that apply exemptions will be obliged to a <strong>new 6 month maintenance period<\/strong>.<\/li><li><strong>The calculation of temporary contracts and training contracts is interrupted<\/strong> who have been affected by an ERTE.<\/li><li><strong>Distribution of dividends is prohibited <\/strong>and access to this aid is restricted for companies domiciled in tax havens.<\/li><\/ul>\n\n\n\n<h3 class=\"gb-headline gb-headline-dc0681e2 gb-headline-text\"><strong>What exemptions apply to companies in ERTE?<\/strong><\/h3>\n\n\n\n<p>In the case of companies with <strong>ERTE for activity impediment<\/strong>, the exemption will be 100%. .<\/p>\n\n\n\n<p>For companies with <strong>ERTE activity limitation<\/strong>, the exemption will be conditional on whether or not the company offers training to its workers, in accordance with the following rules:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Companies with ten or more registered workers<\/strong> as of February 28, 2020: 40% if no training is offered; 80% does offer training.<\/li><li>AND<strong>companies with less than ten workers <\/strong>discharged as of February 28, 2020: 50% if training is not offered; 80% does offer training.<\/li><\/ul>\n\n\n\n<p>RD-Law 18\/2021 i<strong>It also includes special measures for the island of La Palma<\/strong> which has been affected by the volcanic eruption in the Cumbre Vieja area.<\/p>","protected":false},"excerpt":{"rendered":"<p>With the approval of Royal Decree-Law 18\/2021 of September 28, the new extension of the ERTES is included from October 1, 2021 to February 28, 2022.
