{"id":41139,"date":"2021-08-03T11:09:24","date_gmt":"2021-08-03T09:09:24","guid":{"rendered":"https:\/\/eiposgrados.com\/?p=41139"},"modified":"2021-08-03T11:09:24","modified_gmt":"2021-08-03T09:09:24","slug":"facilitation-payments-are-allowed","status":"publish","type":"post","link":"https:\/\/eiposgrados.com\/eng\/blog-dpo\/estan-permitidos-los-pagos-de-facilitacion\/","title":{"rendered":"Are facilitation payments allowed?"},"content":{"rendered":"<p>Facilitation payments, called in English \u201c<em>facilitating payments<\/em>&quot; either &quot;<em>grease payments<\/em>&quot;, are <strong>illegal or unofficial payments<\/strong> performed in exchange for services to which the payer is entitled without the need to make said payment and whose purpose is <strong>ensure or expedite the course of a procedure, specific business or necessary action<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What are these payments like?<\/h2>\n\n\n\n<p>These payments are normally small amounts and are made to public officials to ensure or expedite compliance with a \u201croutine or necessary action\u201d, to which, as we have previously mentioned, the person making these payments has a legal right.<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large is-resized\"><img fetchpriority=\"high\" decoding=\"async\" src=\"https:\/\/eiposgrados.com\/wp-content\/uploads\/2021\/08\/estan-permitidos-los-pagos-de-facilitacion-1024x683.jpg\" alt=\"\" class=\"wp-image-41156\" width=\"543\" height=\"362\" title=\"\"><\/figure><\/div>\n\n\n\n<p>Some examples in which facilitation payments can be made would be the following: <strong>border procedures<\/strong> to introduce or remove perishable foods (transit of goods across the country); register for electricity or telephone supplies in third countries; the <strong>permit obtainment<\/strong>, licenses or other official documents to allow a person to do business in a foreign country; obtaining <strong>certain government documents<\/strong> such as visas or work permits or police protection, among others.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Facilitation payments and bribes<\/h2>\n\n\n\n<p>Now, taking into account the description of this type of payments, you can see how <strong>fit perfectly within the concept of bribery<\/strong>. So much so, that in most places they are considered bribery and are treated as such.<\/p>\n\n\n\n<p>However, and although in most jurisdictions this phenomenon is prohibited, as is the case of Spain, there are other countries, such as the United States, where <em>Foreign Corrupt Practices Act <\/em>(FCPA) <strong>admits under certain circumstances the making of these payments<\/strong> of facilitation.&nbsp;<\/p>\n\n\n\n<p>In this sense, it is sometimes difficult to determine when bribery has occurred and when it is the exception allowed by the FCPA, since there is a very fine line between both behaviors. <\/p>\n\n\n\n<p>And this is where we see the importance of having a <strong>Robust Compliance Management System<\/strong> and a great involvement of the organization&#039;s Senior Management. All of this is in line with the growing trend towards promoting a culture of compliance within organizations and eliminating these types of actions.<\/p>","protected":false},"excerpt":{"rendered":"<p>Are facilitation payments allowed?
