{"id":40522,"date":"2021-07-28T09:12:48","date_gmt":"2021-07-28T07:12:48","guid":{"rendered":"https:\/\/eiposgrados.com\/?p=40522"},"modified":"2021-10-29T17:51:04","modified_gmt":"2021-10-29T15:51:04","slug":"new-remote-work-law","status":"publish","type":"post","link":"https:\/\/eiposgrados.com\/eng\/blog-rrhh\/nueva-ley-de-trabajo-a-distancia\/","title":{"rendered":"The new remote work law"},"content":{"rendered":"<p>The pandemic caused by Covid-19 has brought about many transformations and challenges for the labor market, one of the big changes has been the growth in the number of <strong>workers<\/strong> that <strong>They carry out their work remotely.<\/strong><\/p>\n\n\n\n<p>That is why the government has developed <strong>the new remote work law <\/strong>&nbsp;which is valid from July 11, 2021.<\/p>\n\n\n\n<p>Below we will try to develop the main aspects of this new legislation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is remote work?<\/h2>\n\n\n\n<p>The new law establishes that it is <strong>a form of organizing work or carrying out work activity<\/strong> according to which this,&nbsp;<strong>It is provided at the home of the worker or at the place chosen by him or her.<\/strong>, during <strong>their entire day or part of it, on a regular basis.<\/strong><\/p>\n\n\n\n<p>The new legislation also defines the concept of <strong>telecommuting<\/strong> like remote work through<strong> information systems.<\/strong><\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large is-resized\"><img fetchpriority=\"high\" decoding=\"async\" src=\"https:\/\/eiposgrados.com\/wp-content\/uploads\/2021\/07\/la-nueva-ley-de-trabajo-a-distancia-1024x683.jpg\" alt=\"\" class=\"wp-image-40528\" width=\"587\" height=\"391\" title=\"\"><\/figure><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Which workers are affected by the remote work law?<\/h2>\n\n\n\n<p><strong>The law applies to workers in the general regime<\/strong> who carry out remote work or teleworking<strong> at least one 30% of his day<\/strong> in a <strong>reference period of 3 months or proportional percentage<\/strong> depending on the duration of the contract.<\/p>\n\n\n\n<p>For employment contracts with minors and in internship contracts and for training and apprenticeships, <strong>You can telework as long as a minimum of 50% per day is guaranteed in person.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Is teleworking mandatory?<\/h2>\n\n\n\n<p><strong>Remote work will be voluntary <\/strong>for the <strong>working person<\/strong> and for the<strong> employer<\/strong> yr<strong>will require the signing of the agreement<\/strong> remote work regulated by the new law.<\/p>\n\n\n\n<p><strong>The remote work agreement will be made in writing<\/strong>, either through the initial contract or subsequent document, always before remote work begins. This agreement must also be sent to the SEPE.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is the minimum content of the remote work agreement?<\/h2>\n\n\n\n<p>The new law establishes the minimum content of the remote work agreement to be formalized:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Inventory<\/strong> of the equipment required to work remotely.<\/li><li><strong>Enumeration of expenses and quantification of compensation of expenses<\/strong> derived from remote work and when it must be paid.<\/li><li><strong>Schedule<\/strong> work and availability rules.<\/li><li><strong>Percentage and distribution<\/strong> between in-person and remote work.<\/li><li><strong>Workplace<\/strong> where I develop the face-to-face part of the day.<\/li><li><strong>Place<\/strong> from where you will work remotely.<\/li><li><strong>Notice periods for the exercise of reversibility situations<\/strong>.<\/li><li><strong>Procedure<\/strong> in case of technical difficulties that prevent work.<\/li><li><strong>Control means<\/strong> <strong>business<\/strong> of the activity,<\/li><li><strong>Instructions issued by the company<\/strong>, after consulting the representatives, for the <strong>data protection and information security<\/strong> specific for remote work.<\/li><li><strong>Duration<\/strong> of the agreement.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Right to digital disconnection<\/h2>\n\n\n\n<p>People who work remotely, particularly teleworking, <strong>They have the right to digital disconnection outside of their working hours <\/strong>in the terms established in article 88 of Organic Law 3\/2018, of December 5.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Sanctions related to remote work<\/h2>\n\n\n\n<p><strong>The new legislation establishes new sanctions and violations<\/strong> in matters of labor relations and employment and prevention of occupational risks.<\/p>\n\n\n\n<p>If, for example, the employer refuses to provide the necessary material so that the remote worker can carry out his or her activity, this fact can be considered a serious infraction and the penalty would range between \u20ac751 and \u20ac7,500.<\/p>\n\n\n\n<p><strong>Teleworking is already a reality in Spain<\/strong> and with this new legislation a great step is taken and a new panorama opens for companies and professionals in our country.<\/p>","protected":false},"excerpt":{"rendered":"<p>Teleworking is here to stay, that is why there is a new remote work law and we tell you everything about it.
