{"id":32800,"date":"2021-05-04T09:25:08","date_gmt":"2021-05-04T07:25:08","guid":{"rendered":"https:\/\/eiposgrados.com\/?p=32800"},"modified":"2021-05-04T09:49:15","modified_gmt":"2021-05-04T07:49:15","slug":"fifth-anti-money-laundering-directive","status":"publish","type":"post","link":"https:\/\/eiposgrados.com\/eng\/blog-dpo\/quinta-directiva-contra-el-blanqueo-de-capitales\/","title":{"rendered":"Fifth Anti-Money Laundering Directive"},"content":{"rendered":"<p>\u00a0On June 19, 2018, the<strong> Fifth Directive (EU) 2018\/84 <\/strong>by virtue of which <strong>Directive (EU) 2015\/849, of May 20, 2015, is amended<\/strong>, relative to the <strong>prevention of the use of the financial system for money laundering or terrorist financing<\/strong> (Fourth Directive).\u00a0<\/p>\n\n\n\n<div class=\"wp-block-image\"><figure class=\"aligncenter size-large is-resized\"><img fetchpriority=\"high\" decoding=\"async\" src=\"https:\/\/eiposgrados.com\/wp-content\/uploads\/2021\/05\/quinta-directiva-contra-el-blaqueo-de-capitales-1024x640.jpg\" alt=\"fifth anti-money laundering directive\" class=\"wp-image-32803\" width=\"590\" height=\"369\" title=\"\" srcset=\"https:\/\/eiposgrados.com\/wp-content\/uploads\/2021\/05\/quinta-directiva-contra-el-blaqueo-de-capitales-1024x640.jpg 1024w, https:\/\/eiposgrados.com\/wp-content\/uploads\/2021\/05\/quinta-directiva-contra-el-blaqueo-de-capitales-300x187.jpg 300w, https:\/\/eiposgrados.com\/wp-content\/uploads\/2021\/05\/quinta-directiva-contra-el-blaqueo-de-capitales-768x480.jpg 768w, https:\/\/eiposgrados.com\/wp-content\/uploads\/2021\/05\/quinta-directiva-contra-el-blaqueo-de-capitales-1536x960.jpg 1536w, https:\/\/eiposgrados.com\/wp-content\/uploads\/2021\/05\/quinta-directiva-contra-el-blaqueo-de-capitales-2048x1280.jpg 2048w, https:\/\/eiposgrados.com\/wp-content\/uploads\/2021\/05\/quinta-directiva-contra-el-blaqueo-de-capitales-264x165.jpg 264w, https:\/\/eiposgrados.com\/wp-content\/uploads\/2021\/05\/quinta-directiva-contra-el-blaqueo-de-capitales-scaled.jpg 1920w\" sizes=\"(max-width: 590px) 100vw, 590px\" \/><\/figure><\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Among the main novelties of this Fifth Directive, the following stand out:<\/h2>\n\n\n\n<ul class=\"wp-block-list\"><li><strong>Increased efficiency<\/strong> from the list of high-risk third countries drawn up by the Commission, harmonizing the treatment of these countries at Union level.<\/li><li><strong>Guarantee that the categories of clients established by obligated entities are periodically reviewed<\/strong>.<\/li><li><strong>Emergence of new subjects<\/strong> obligated and extension of obligations for some of the already existing obligated subjects, specifically:&nbsp;<ul><li><strong>Tax advisors, external accountants and auditors<\/strong>.&nbsp;<\/li><li><strong>Virtual currencies.<\/strong> Virtual currencies should not be confused with electronic money, and their use as means of exchange, investment, reserve-of-value products or use in online casinos must be taken into account. The objective of the Directive is to cover all possible uses of virtual currencies.<\/li><li><strong>Merchants or intermediaries<\/strong> in the marketing of works of art, in cases where the amount of the transaction or a series of related transactions is equal to or greater than \u20ac10,000.<\/li><li><strong>real estate agents,<\/strong> in relation to transactions for which the monthly rent is equal to or greater than \u20ac10,000.<\/li><\/ul><\/li><li><strong>Public access to real ownership records<\/strong>. Member States should facilitate public access to ownership information through central registries.<\/li><li><strong>Limits are reduced <\/strong>in relation to the use of prepaid instruments.<\/li><\/ul>\n\n\n\n<p>It is clear that the European Union, in the fight against money laundering, with this set of rules focuses on the prevention of this type of crime. <\/p>\n\n\n\n<p>That is why all <strong>member state organizations are obliged to adapt<\/strong> to ensure compliance with the fifth Directive.
