of the Birth and Childcare Leave: Key points of Royal Decree-Law 9\/2025"},"content":{"rendered":"<p>He <strong>Royal Decree-Law 9\/2025, of July 29<\/strong>, introduces one of the most relevant reforms in the area of work-life balance in recent years: the <strong>extension of birth and childcare leave<\/strong>.<\/p>\n\n\n\n<p><br>With this measure, Spain completes the transposition of the <strong>Directive (EU) 2019\/1158<\/strong>, whose objective is to guarantee paid parental leave and promote co-responsibility between parents.<\/p>\n\n\n\n<p>This reform not only extends the leave the impact of <strong>extension of birth and childcare leave<\/strong>Let&#039;s look at some assumptions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Situation 1:<\/strong> Married parent wishing to extend their parental involvement during the first year. After the mandatory 6 weeks, they can take 8 consecutive weeks and reserve 3 weeks before the child turns 12 months old. From 2026, they can add 2 more weeks until the child turns 8.<\/li>\n\n\n\n<li><strong>Situation 2:<\/strong> Single-parent family. A single mother will have 32 weeks: 6 mandatory, 22 flexible during the first 12 months and 4 additional paid weeks up to 8 years.<\/li>\n\n\n\n<li><strong>Situation 3:<\/strong> Parents who work at the same company. If both request voluntary weeks at the same time, the company may limit it for justified organizational reasons and in writing.<\/li>\n\n\n\n<li><strong>Situation 4:<\/strong> Flexible use during school holidays. The parent can reserve the additional 2 weeks to enjoy during the summer, coinciding with the school closure.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Retroactive application and transitional provisions<\/strong><\/h2>\n\n\n\n<p>The rule includes a transitional provision that allows the application of <strong>2 additional weeks (4 in single-parent families)<\/strong> with <strong>retroactive nature<\/strong> to births or adoptions that have occurred since <strong>August 2, 2024<\/strong>.<\/p>\n\n\n\n<p>Those who have already exhausted their permit will be able to request additional weeks starting from <strong>January 1, 2026<\/strong>, without the need for a new recognition of the right.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Relationship with the parental leave of Royal Decree-Law 5\/2023<\/strong><\/h2>\n\n\n\n<p>Parental permission of <strong>8 weeks unpaid<\/strong>, introduced in 2023, remains in effect.<br>With the new Royal Decree-Law 9\/2025, the <strong>2 additional paid weeks<\/strong> Birth leave is included within the work-life balance package required by European regulations. <strong>without replacing<\/strong> to unpaid parental leave.<\/p>\n\n\n\n<p>In this way, each parent will be able to enjoy:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>19 paid weeks<\/strong> (32 in single-parent households).<\/li>\n\n\n\n<li><strong>8 additional unpaid weeks<\/strong>until the child turns 8 years old.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"gb-headline gb-headline-9eb71845 gb-headline-text\"><strong><strong>Impact on the labor management of companies<\/strong><\/strong><\/h2>\n\n\n\n<p>The case underscores the importance of regulating and supervising the use of biometric data to ensure that fundamental rights are not violated.
